1. Who provides ArchiveKong
ArchiveKong is developed and provided by Selim Kaltakkıran, an individual based in Turkey, operating under the ArchiveKong brand ("we", "us", or "our"). Contact us at selim@archivekong.com for product support or questions about these terms.
These terms apply to archivekong.com, the ArchiveKong desktop application, and our optional hosted services. By using these services, you agree to these terms. Mandatory rights under the consumer laws that apply to you remain unaffected.
2. The product and Premium purchase
ArchiveKong is a Windows application for organizing and playing your own local music and video files. It does not supply movies, music, or a subscription to third-party media. You must have the rights needed to access and use the media you add.
The core desktop library is free. Premium costs $5 USD with a one-time payment and includes LAN browser access, remote access through the hosted relay, web actor search, and custom skins, in addition to the free core. See Pricing for the offering.
Includes all current and future Premium features — one payment, lifetime access. No subscription or recurring charges apply. Future Premium features will not require another purchase. This does not promise a particular future feature or release date. Network-dependent features require an internet connection and may experience interruptions.
Any applicable taxes and the final total will be shown at checkout before you pay. Premium is associated with your account; sign in inside the application to purchase and access it. Keep your purchase confirmation so we can help with activation issues. Contact selim@archivekong.com if access is not enabled after a successful purchase.
3. Purchases through Paddle
When a purchase is made through Paddle, Paddle acts as the Merchant of Record and authorized reseller, handling payment, applicable transaction taxes, receipts, and payment-related refunds. ArchiveKong remains responsible for providing the software and product support.
Paddle purchases are also subject to Paddle’s Buyer Terms and Privacy Policy. This section applies to orders processed by Paddle.
4. Refunds
We offer a full refund on request within 14 calendar days of purchase, including if you have downloaded or used Premium. Read our Refund policy for how to request one. This policy does not restrict statutory consumer rights. When a Premium purchase is refunded, the Premium entitlement for that purchase is withdrawn; the free core remains available.
5. Accounts, access, and acceptable use
Provide accurate account information and protect your password, device credentials, and pairing codes. You are responsible for the devices and people you authorize to access your library. Contact us if you suspect unauthorized access.
Do not use ArchiveKong or its hosted services to infringe copyright or other rights, distribute illegal material, access another person’s account or device without permission, distribute malware, or attack or disrupt services. Do not resell or share your Premium account credentials. Rights granted by an applicable open-source license are not limited by this restriction.
We may restrict hosted-service access to address fraud, security threats, or a material breach of these terms. Contact us to challenge an error. Restrictions do not remove mandatory consumer rights or any refund you are legally entitled to.
6. Your files, privacy, and third parties
You retain ownership of your files and library data. Local use does not upload your full library to us. When you enable remote access or request online metadata, the data needed for that feature is transmitted to the relevant services. Our Privacy policy explains this processing.
AI and web search results may be inaccurate. Review suggested metadata and external links before using them. Third-party websites and services have their own terms and privacy policies.
7. Software licenses and availability
ArchiveKong is currently a Windows alpha. Keep backups before making changes to your library. The software may contain bugs and hosted services may be unavailable during maintenance or outages.
Code and components released under open-source licenses remain governed by those licenses. A Premium purchase provides access to our Premium offering; it does not transfer ownership of our trademarks or third-party content, or override open-source license rights.
8. Responsibility and consumer protections
To the extent permitted by law, the alpha software and hosted services are provided as available, without a guarantee of uninterrupted or error-free operation. Nothing in these terms excludes liability that cannot lawfully be excluded, mandatory warranties, remedies for defective digital products, or other consumer protections. Our lifetime Premium commitment and Refund policy remain part of the offering.
9. Changes and contact
Updates to these terms will be published here with a revised date. Changes will not retroactively remove the lifetime Premium entitlement or refund rights attached to an existing purchase. For questions, activation help, or complaints, contact Selim Kaltakkıran at selim@archivekong.com.
